Record of Fact and Legal - PeaceKeeper Digital Platforms and Chronology

    Opening Statement of Fact

    From the inception of PeaceKeepers, digital platforms used to deliver courses, videos, and supporting materials were operated on the basis of shared access and shared purpose, not personal ownership.

    Marc Horn provided Brian Reece with full access to the PeaceKeepers SiteGround hosting account by sharing credentials at the outset of the project. Brian Reece, in turn, provided Marc Horn with full access to the Vimeo and YouTube accounts used to host and distribute PeaceKeepers content. This reciprocal granting of full administrative access was consistent across platforms.

    At no point during this period was it represented that these platforms were personal assets held independently by either party. They were used operationally as PeaceKeepers infrastructure in furtherance of a common purpose: the free public delivery of PeaceKeepers educational materials and courses.

    Certain videos were restricted only in the sense that they were accessible exclusively through the LearnDash course module, rather than as standalone public videos.

    For the applicable legal principles governing this arrangement, see the Position in Law below.

    1. Chronology of Events

    Project Setup and Platform Access

    From inception
    PeaceKeepers educational materials, courses, and videos were created and distributed free of charge, without monetisation or paywall.

    At the outset:

    • Marc Horn provided Brian Reece with full access to the PeaceKeepers SiteGround hosting account.

    • Brian Reece provided Marc Horn with full access to the Vimeo and YouTube accounts used for PeaceKeepers content.

    This reciprocal access reflected a shared understanding that the platforms were being used as PeaceKeepers infrastructure.

    Course Delivery and Video Hosting Model

    Early course development period
    Courses were delivered via LearnDash.

    Brian Reece advised that certain course videos were hosted on Vimeo rather than YouTube. This was presented as a practical hosting arrangement.

    Those videos:

    • were embedded within LearnDash course modules;

    • were accessible only to enrolled course participants;

    • were not publicly accessible or indexed as standalone videos.

    Use and Control of the YouTube Channel

    From inception to late December 2025

    Marc Horn had full administrative access to the YouTube channel used for PeaceKeepers content. The channel functioned as PeaceKeepers’ primary public-facing video platform.

    There was no indication during this period that the channel was a personal asset of Brian Reece rather than PeaceKeepers infrastructure.

    Discovery of Channel Ownership and Role Change

    29 December 2025
    Marc Horn reviewed the YouTube channel settings and observed for the first time that Brian Reece was listed as channel owner, notwithstanding shared administrative access from inception.

    Acting in good faith, within platform permissions, and on the basis of a reasonable belief that the channel was PeaceKeepers infrastructure, Marc Horn adjusted roles to align organisational control with operational use.

    Shortly thereafter, Brian Reece downgraded Marc Horn’s access, preventing further administration and reasserting sole control. This marked the point at which control of the YouTube platform became disputed.

    Resignation and Subsequent Platform Actions

    Late December 2025 – early January 2026
    Brian Reece resigned as a trustee of PeaceKeepers.

    Following his resignation, he:

    • made PeaceKeepers videos on the original YouTube channel private;

    • rebranded the channel for a separate project;

    • declined to transfer control of the channel despite its prior operational use for PeaceKeepers.

    This disrupted beneficiaries relying on the materials.

    Creation of a New PeaceKeepers YouTube Channel

    January 2026
    To restore continuity, a new PeaceKeepers YouTube channel was created and verified.

    When Marc Horn began uploading course videos to the new channel, copyright warnings were triggered on certain videos. This was the first time such warnings were encountered personally.

    This clarified the earlier hosting arrangement: specific course videos had been placed on Vimeo to avoid automated copyright claims on YouTube while remaining accessible securely to enrolled users via LearnDash.

    Subsequent Context

    The combined facts that:

    • PeaceKeepers content was free of charge;

    • platform access was shared reciprocally from inception;

    • certain videos triggered copyright warnings only when uploaded to YouTube in January 2026;

    • those videos were restricted via LearnDash;

    • the YouTube channel functioned as PeaceKeepers’ primary public platform;

    are material to understanding the governance and legal position set out below.

    2. Position in Law: Trust, Equity, and Beneficial Ownership

    (This section provides legal context for the facts above. It does not assert allegations.)

    Trusts arise by substance, not labels

    In English law, a trust arises from substance and conduct, not from the use of particular words or awareness that a trust exists.¹²

    Equity distinguishes legal title from beneficial ownership

    Equity separates legal title from beneficial ownership and treats assets held for others as subject to fiduciary obligation regardless of form.³⁴

    Beneficiaries are the equitable owners

    Where assets are deployed for a defined purpose and for the benefit of others, beneficiaries are the true owners in equity; trustees hold powers of control only.⁵

    Trusteeship does not depend on intention

    A person becomes a trustee by assuming control over property affecting others’ interests, regardless of intention or belief.⁶

    Trustees cannot appropriate trust assets

    Trust assets cannot be unilaterally recharacterised as personal property or withdrawn for personal advantage.⁷⁸

    Legal title does not defeat equity

    Equity restrains unconscionable reliance on legal title where property is held for another’s benefit.⁹¹⁰

    Application to PeaceKeepers

    Applying these principles, PeaceKeepers platforms were held in equity for the benefit of PeaceKeepers’ beneficiaries. Control was exercised by trustees in a fiduciary capacity, not as personal ownership.

    RECORD OF CHRONOLOGY- 16 January 2026

    Governance Chronology: Trustee Proceedings, Platform Control, and Resignations

    Preface – Nature of This Record

    This document is published as a Record of Fact.

    It sets out, in chronological order, actions taken by named individuals acting in trustee or governance roles within PeaceKeepers, together with related platform actions affecting beneficiary-facing materials.

    Names are used deliberately and appropriately.
    No opinion, motive, inference, or commentary is expressed.

    Pre-incorporation period — Project operation prior to corporate existence

    Prior to the incorporation of the PeaceKeepers Foundation on 3 July 2024, the PeaceKeepers project operated without a corporate entity. During this period, individuals including Brian Reece participated in the project, exercised control over platforms and materials, and acted in furtherance of PeaceKeepers as presented publically.

    Where governance or trustee terminology appears, it records how roles were described, acknowledged, or exercised in practice by those involved, including as stated in written resignation correspondence, without asserting legal conclusions.

    April / May 2021- Brian Reece joins PeaceKeepers project

    Brian Reece joins the PeaceKeepers project and begins participating in the operation and management of digital platforms used for PeaceKeepers materials.

    Shared platform credentials at inception (SiteGround / Vimeo / YouTube)

    Initial platform access arrangement

    At the outset of the project, Marc Horn provided Brian Reece with full access to the PeaceKeepers SiteGround hosting account by sharing credentials.

    Brian Reece provided Marc Horn with full access to the Vimeo and YouTube accounts used for PeaceKeepers content.

    No reservation of personal ownership was expressed at that time.

    May–June 2021 — Authorship and Course Material Creation (Clarification)

    Between May and June 2021

    All PeaceKeepers course materials, written content, analytical frameworks, and educational structures were authored and created exclusively by Marc Horn. This includes the substantive course text, methodology, sequence, and explanatory content forming the PeaceKeepers programme.

    During this period and thereafter, no alterations, revisions, or substantive changes were made by Brian Reece to the authored course materials or to the recorded video content. At no point did Brian Reece modify, rewrite, adapt, or transform the substance of the courses or videos.

    Brian Reece’s involvement was limited to technical implementation only, including uploading, formatting, and arranging the authored materials within the LearnDash course platform and associated delivery systems. These activities did not involve editorial judgment, content creation, or alteration of the underlying materials.

    No record exists prior to January 2026 of any claim by Brian Reece to authorship, joint authorship, editorial contribution, or ownership of the PeaceKeepers course materials or videos, nor any objection to PeaceKeepers’ continued hosting, use, or migration of that content.

    June 2021 – January 2026 — Continuity of Content Without Alteration

    From initial creation in 2021 through to January 2026, the PeaceKeepers course materials and associated videos remained substantively unchanged. Platform activity undertaken during this period related solely to technical hosting, formatting, or delivery, and did not alter the content itself.

    This continuity establishes that all course and video materials re-hosted or migrated after January 2026 are the same materials originally authored by Marc Horn, without modification or transformation.

    Pre-2026 — Absence of Objection or Withdrawal

    No platform logs, correspondence, revision histories, or contemporaneous records prior to January 2026 record any objection, withdrawal of consent, or assertion of exclusive ownership by Brian Reece in respect of the PeaceKeepers course materials or videos.

    Use of Vimeo for restricted course content

    Certain PeaceKeepers course videos were hosted on Vimeo rather than YouTube and embedded solely within LearnDash course modules. These videos were not publicly accessible. The hosting arrangement was used to address automated copyright flagging encountered when some content previously on Vimeo was uploaded to YouTube. Marc Horn became aware of this issue when copyright warnings were generated during uploads to the new PeaceKeepers YouTube channel in January 2026.

    3 July 2024 — Incorporation of the PeaceKeepers Foundation

    The PeaceKeepers Foundation was incorporated on 3 July 2024. All project activity prior to this date occurred without a corporate entity.

    Public trustee update videos

    In publicly available PeaceKeepers update videos, trustee-based governance, including the appointment of trustees and trustee decision-making, is described by Marc Horn and Lance Peatling. Brian Reece is present in these videos and no contemporaneous objection is recorded to the governance framework described.

    • On the same date, Brian Reece issues a document titled
      “Fiduciary Tribunal Standing Order: Procedural Timeline & Meeting Protocol”, introducing:

      • a verdict-only meeting structure,

    • 17:14 — Lance Peatling confirms that a meeting is set for the following day at 4pm, stating “just us.”
    • 17:36–17:40 — Marc Horn reiterates that no meeting should proceed until the procedural contradictions are resolved.

    • 19:45 — Marc Horn circulates a document titled
      “Settlement of Unity: Fiduciary Audit & Proposal for Governance”, proposing:

      • a forensic reply on substance over form,
      • critique of closed-record procedures,
      • a reconciliation protocol,
      • and governance safeguards (“13 Traditions”).

    21 December 2025 — First resignation - Hugh Goggin

    • Brian Reece rejects Djon Porrotte’s written assessment (submitted as a PDF) on the stated basis that it did not provide “YES / NO” answers to the questions posed;
    • Brian Reece raises privacy concerns regarding trustee communications and the circulation of documents;
    • Brian Reece repeatedly demands binary (“YES / NO”) answers to a series of questions, notwithstanding objections raised regarding context, reasoning, and fiduciary process.

    Marc Horn records objections that:

    • rejecting a trustee’s reasoned assessment on format grounds conflicts with peer-to-peer fiduciary principles; and
    • the process had become public once a Statement of Case and demand for determination were issued in the name of the trust.

    18:51 – Djon Porrotte reiterates cooling down period again, having clarified his position, and confirming to Brian that he will respond to the further OFFICIAL TRIBUNAL RESPONSE2.pdf

    [DATE: 23 January 2026] — Formal Reminder and Second Notice (Brian Reece)

    Marc Horn issued a formal reminder and second notice to Brian Reece, referencing the resignation, prior notice, platform enforcement history, and updated copyright position, and providing an opportunity to amend or remove material reproducing the PeaceKeepers framework.

    [DATE: 26 January 2026] — Platform Record Clarification and Further Public Statements (Brian Reece)

    A statement of facts was submitted to YouTube for record purposes to clarify the scope of the PeaceKeepers educational framework and the sequence of platform actions relating to a prior copyright enforcement process.

    That submission recorded that the PeaceKeepers framework is authored by Marc Horn and that prior platform enforcement concerned framework-level reproduction, including the selection, sequencing, and analytical architecture of the framework as expressed through spoken content, descriptions, and diagrammatic material.

    In written communications dated 26 January 2026, Brian Reece characterised the PeaceKeepers framework as relying upon a “simplistic 3-tier model (Grantor > People > Agent)” and stated that his work had “evolved significantly beyond” that formulation, describing a revised multi-level constitutional hierarchy as a further development of his work.

    In the same communications, Brian Reece stated that an earlier video had been “deprecated and removed” on the basis that it no longer met his standards for accuracy and asserted that the removal was voluntary.

    For completeness of the record, the referenced video had previously been removed from public display by YouTube following a copyright infringement complaint. This entry records the statements made and the platform context without amending earlier enforcement records.

    [DATE: Ongoing] — Monitoring of Public Representations

    PeaceKeepers continues to monitor public representations relating to its educational framework for accuracy and compliance with stated authorship and licence positions.

    No further action has been taken as of the date of this entry, pending any new conduct.

    Notes on Record Integrity

    • These entries are additive only and do not revise, retract, or reinterpret earlier published records.

    • All entries are limited to verifiable communications, public statements, and platform actions.

    • No assumptions, presumptions, motives, or conclusions are asserted beyond factual clarification required to maintain accuracy of the public record.

    • Hugh Goggin responded to the invitation with the statement “No Comment” and did not identify any factual inaccuracy or submit supporting evidence.

    • Brian Reece responded by email dated 29 January 2026, acknowledging receipt of correspondence and addressing matters relating to:

      • content updates on his own channel;

      • objections to data processing and publication of correspondence; and

      • rejection of participation in the governance record process.

      In that response, Brian Reece did not identify any specific factual inaccuracy in the Statement of Facts or governance chronology, nor did he submit evidence supporting any proposed correction.

    30–31 January 2026 – Further Opportunity to Correct the Record

    On 30 January 2026, prior to the meeting of the remaining trustees, and in the interests of fairness and completeness of the governance record, Hugh Goggin and Brian Reece were each given a further opportunity to provide any concise clarification or correction limited to factual accuracy, with a stated deadline of 12:00 noon on Saturday 31 January 2026.

    No further responses, clarifications, or evidence-based corrections were received from either Hugh Goggin or Brian Reece by the deadline specified.

    31 January 2026 – Expiry of Opportunity

    In the absence of any substantiated factual corrections being provided within the time afforded, the opportunity to correct the factual record expired, and the trustees proceeded on the basis of the existing Statement of Facts and governance chronology.

    The governance record remains open to correction should any specific, evidenced factual inaccuracy be identified in future.
