When is a Judgment Not a Judgment? PeaceKeepers Expose Deceit and Demand Unblemished Accountability from the Judiciary

The PeaceKeepers organization continues its relentless pursuit of justice, and our latest analysis of the High Court judgment reveals a chilling truth: the manipulation of judicial decisions to achieve predetermined outcomes. This deep dive exposes not only errors of law but also a concerning application of mind to deceive, underscoring our unwavering commitment to holding the judiciary to the highest standards of integrity.

The Right to a Reasoned Judgment: A Non-Negotiable Imperative

At the core of this particular challenge is a fundamental principle of justice: a decision without reasons is unlawful. This means that every individual has an absolute right to receive a properly reasoned judgment. Until such a judgment is provided, you are legally entitled to remain in the courtroom. No security, no police, can lawfully remove you if you are asserting this right. This is your right, and it must be upheld.

In our case, we contended that District Judge Healey failed to provide a reasoned judgment that adequately addressed the key issues and breached the principle of stare decisis (precedent), where higher courts bind lower courts unless there is compelling reason to deviate. Judge Dame Hill, in her High Court ruling, concluded that his judgment did give “detailed consideration of the facts and law.” However, our meticulous review shows this to be untrue; for example, the seminal case of Ashby v. White was entirely ignored, and none of our submitted authorities were properly rebutted.

Deceit in Judgment: A Closer Look at the High Court’s Actions

The most disturbing aspect of this judgment lies in how Judge Dame Hill handled the issue of reasoned judgments. She effectively admitted that District Judge Healey’s original judgment was inadequate by stating that “further reasons were effectively given” in a second, later-issued document. This is a fundamental error: justice demands that a judgment be reasoned at the time it is delivered, not patched up retrospectively. To allow otherwise undermines the entire appeals process and a litigant’s ability to respond to the original ruling.

Even more significantly, Liverpool City Council, the opposing party, agreed with us that District Judge Healey’s judgment did not address their key argument regarding the Valuation Tribunal. This means both sides recognized the judgment’s deficiency. Yet, Judge Dame Hill astonishingly dismissed this by stating it “worked in Mark’s favour,” completely disregarding the profound public importance of a judge’s duty to provide a complete and reasoned judgment, irrespective of individual outcomes.

This pattern extends to the manipulation of the judgment document itself. When PeaceKeepers submitted detailed “corrections” to the draft judgment—pointing out, for instance, a factual error where Judge Dame Hill incorrectly stated our representative “did not appear to accept” a point (when he demonstrably did)—she did not make a transparent correction. Instead, she subtly removed the evidence from its original, damning location and placed it elsewhere in the judgment, effectively obscuring the critical point that Liverpool Council itself conceded the judge’s failure to reason. This intricate manoeuvre demonstrates an application of mind to deceive, pointing to a predetermined outcome.

The Problem of Wilful Refusal and Moral Corruption

This is the closest evidence we have encountered of what can only be described as deceit within the judiciary. While we refrain from using the term “corruption” without explicit evidence of financial benefit or widespread conspiracy, this deliberate act of obscuring facts to manipulate the reader’s perception is, at the very least, an act of profound moral corruption. It is not mere incompetence; it is an intentional act to prevent the acknowledgment of an arguable point that would have compelled a full hearing for PeaceKeepers.

This highlights the critical importance of scrutinizing not just the final judgment, but also the underlying submissions and the entire procedural history of a case. Judges, like all parties, are bound by the law, and their judgments must be based on, and reflect, a transparent engagement with the relevant legal arguments. A judgment that fails to explain its reasoning, or worse, deceptively manipulates its content, abrogates the judge’s duty to the public and to their judicial oath.

Three Undeniable Victories and the Path Forward

Despite the High Court’s formal refusal and the baffling certification of our grounds as “totally without merit,” the substance of this case has yielded undeniable victories for the rule of law:

  • The Valuation Tribunal is NOT an alternative remedy: Unless a challenge is solely about the dwelling or the amount of council tax, Magistrates’ Courts can no longer divert you to a Valuation Tribunal.
  • Magistrates’ Courts MUST now listen to all your arguments: This forces a direct engagement with legal challenges that were previously avoided.
  • Judges MUST provide reasoned judgments on all key points: This is a direct mandate for accountability and transparency, ensuring that judges cannot simply issue arbitrary decisions.

These represent massive victories for every citizen dealing with council tax enforcement. They fundamentally empower you and restore due process where it was previously circumvented. We are resolute in pushing this battle to the Court of Appeal. As a retired High Court judge once conceded, our journey aims to rectify nearly 300 years of systemic abuse of the rule of law, a goal now accelerated by modern technology and the unwavering support of our community.

PeaceKeepers believes that the integrity of our justice system depends on transparency and accountability. We encourage everyone to scrutinize these judgments, understand their rights, and hold those in power accountable.
